App Terms of Service
Terms for the Shopify apps Address Guard, E-Rechnung & GoBD and DATEV Abgleich
Version 1.0 · As of: October 2026
See also: App Privacy Notices · Data Processing Agreement · Privacy Policy · Terms of Service
These terms of service apply to the Shopify apps of Andre Prochiner, Eichenweg 34b, 9581 Ledenitzen, Austria, trading as AppHighway ("we"). They supplement the terms of the Shopify App Store, through which the apps are installed and billed. By installing an app you accept these terms and the data processing agreement.
1. Scope and Contracting Party
These terms apply to the use of the apps Address Guard, E-Rechnung & GoBD and DATEV Abgleich (together, the "apps") in a Shopify store. The contracting party is the owner of the store in which the app is installed (the "merchant", "you").
The apps are directed exclusively at businesses that operate the store as part of their trade or independent professional activity. Consumers are excluded from use; no right of withdrawal applies.
Our data processing agreement, which comes into effect upon installation, governs the processing of your customers' personal data. On data protection matters, it takes precedence over these terms. Deviating terms of the merchant do not apply, even if we do not expressly object to them.
2. Conclusion, Term and Termination
The contract comes into effect when you install the app from the Shopify App Store and confirm the access rights and subscription price displayed by Shopify. It runs for an indefinite period.
You may terminate the contract at any time by uninstalling the app from your store. Billing ends with the current Shopify billing period; there is no notice period or cancellation fee. We may terminate the contract giving three months' notice to the end of a month; the right to terminate for good cause remains unaffected. Good cause exists in particular where the merchant misuses the app or breaches Shopify's developer terms.
Section 7 governs what happens to your data after uninstallation.
3. Description of Services
The scope of functionality of each app follows from its App Store listing, the documentation on apphighway.com and the app itself, in each case in its current version. Every app shows you in a log what it has done; notices and clarification items form part of the service.
Address Guard
Address Guard checks German delivery addresses at the Shopify checkout for a correct Packstation and Postnummer format, missing house numbers, and a DHL-compatible structure. The check runs as a Shopify Function in the checkout; the app does not verify whether an address is actually deliverable.
E-Rechnung & GoBD
E-Rechnung & GoBD creates invoices, cancellations and corrections from paid Shopify orders as PDF and as XRechnung, ZUGFeRD or Peppol BIS, validates them with a validation service, assigns a gapless sequence number, delivers them by e-mail on request, archives them with a verification chain, and provides export and handover packages for you and your tax firm. The accuracy of the invoice details (master data, tax rates, tax exemptions, date of supply, mandatory information) depends on your settings and the order data in Shopify; the app flags missing mandatory information but does not replace your own review.
DATEV Abgleich
DATEV Abgleich matches Shopify Payments payouts to orders, books fees, and creates accounting batches in the DATEV format (EXTF) together with document-field lists and clarification items. The batches are a booking proposal for your tax firm; they replace neither your bookkeeping nor the review by your tax adviser. The app flags cases it cannot match with confidence as clarification items instead of booking them.
The apps do not provide tax, legal or accounting advice. Notices in the apps and in the documentation regarding tax rules are general explanations of the procedure implemented by the app; assessing your individual case remains your responsibility and that of your tax firm.
The apps require the Shopify platform and use its interfaces. Changes by Shopify to interfaces, webhooks, checkout extensions or billing mechanisms may affect the scope of functionality; we adapt the apps within a reasonable time.
4. Prices and Billing
Prices follow from the respective App Store listing at the time of installation. Billing takes place exclusively through Shopify's billing function (Shopify Billing) on your Shopify invoice; we do not collect payment data. All prices are exclusive of statutory VAT, where shown by Shopify.
We bill for what the app does, never for your store's order volume. For E-Rechnung & GoBD, the number of invoices issued in the calendar month determines the plan (Free: up to 5, Starter: up to 100, Business: up to 500, Pro: unlimited). Once a plan's quota is reached, the app issues no further invoices until the start of the next month or a plan change; drafts are retained. Address Guard and DATEV Abgleich are billed at a fixed monthly price; a trial period stated in the listing is free of charge and ends automatically if you uninstall the app before it expires.
We announce price changes at least 30 days in advance. Shopify obtains your renewed consent for a price increase; without consent, the contract ends at the end of the current billing period. Refunds are governed by the rules of the Shopify App Store.
5. Merchant Obligations
You enter complete and accurate information in the apps (in particular the invoice issuer's master data, tax numbers, bank details, and tax and booking mode) and keep it up to date. You review the documents, exports and notices generated by the apps with the diligence of a prudent business person before using or passing them on.
You are responsible for complying with your own commercial, tax and data protection obligations, in particular for retaining issued invoices in the form and for the duration required by law (Germany: § 147 AO, § 14b UStG; Austria: § 132 BAO, § 11(2) UStG 1994) and for bookkeeping. The apps support you in this but do not replace your own safeguarding of records.
You use the apps only for stores you operate yourself, and only within the functions the apps offer. You do not circumvent plan limits, access app interfaces not intended for merchants, or carry out load or security tests without our prior consent.
You inform us without delay of any recognisable errors in the apps, in particular incorrectly generated documents or exports, so that we can fix them. An error report includes the store domain, the affected order or run, and the time of the incident, but no access credentials.
6. Availability, Maintenance and Development
We aim for uninterrupted operation but do not guarantee any particular availability. We announce maintenance work that affects operation in the app dashboard where possible in advance and schedule it for low-traffic periods. We are not responsible for disruptions arising from the Shopify platform, the internet, or force majeure.
We continue to develop the apps and may change or add functions as long as the essential scope of services is maintained. We document changes to behaviour that are material to your bookkeeping or invoices in the app's notices and in the documentation.
If we discontinue an app, we announce this at least three months in advance and ensure that you can export your data before the end of that period.
7. Data, Archive and End of Contract
Data an app generates for you (invoices, archive, exports, logs) belongs to you. You can download it through the app at any time during the term.
Processing ends on uninstallation. E-Rechnung & GoBD then sends you an e-mail with a download link to the archive export of all issued invoices and to the handover package of open drafts; both packages remain available until day 28 after uninstallation. From day 29 we delete your store's drafts, handover packages, sessions and settings, with this deletion completed at the latest on day 30. Issued invoices remain stored beyond that for as long as we operate the service and until their statutory retention period expires or you instruct their deletion; retention by us is nevertheless not promised — please download the archive export in good time. For Address Guard and DATEV Abgleich, we delete the store data on the shop/redact webhook, which Shopify sends 48 hours after uninstallation.
The data processing agreement (Section 10) governs the details of deletion; we provide the relevant app's deletion concept on request.
8. Warranty
We provide the apps in the condition described in the App Store listing and the documentation, and fix reported defects within a reasonable time. We give no warranty for the apps' compatibility with your individual tax situation, with other apps, or with customisations of your theme.
The formats XRechnung, ZUGFeRD and Peppol BIS, as well as the DATEV format, are checked using the validation tools named in the documentation at the time. Whether a particular recipient or program accepts a document also depends on its own configuration; please report any discrepancies to us together with the validation log.
9. Liability
We are liable without limitation for intent and gross negligence, and for damage arising from injury to life, body or health.
For slight negligence, we are liable only for the breach of essential contractual obligations, that is, obligations whose fulfilment is a prerequisite for the proper performance of the contract and on whose observance you may rely, and only for foreseeable, typical damage. This liability is limited per claim and per contract year to the total fees you paid for the affected app in the twelve months preceding the damaging event, but at least EUR 500.
In cases of slight negligence, we do not compensate for lost profit, indirect or consequential damage, or tax disadvantages, late-payment surcharges or interest arising because information in Shopify or in the app's settings was incorrect or incomplete, because generated documents or exports were used without review, or because the archive export was not downloaded after uninstallation.
For loss of data, we are liable only up to the amount that would have been required to restore it had you carried out proper and regular data backups yourself. Liability under the Product Liability Act and under Art. 82 GDPR remains unaffected. To the extent our liability is excluded or limited, this also applies to our vicarious agents.
10. Support
We provide support by e-mail at support@apphighway.com and through the contact form on apphighway.com, in German and English. We generally respond within two business days on working days; we do not guarantee any particular response or resolution time. Support covers questions about using the apps and fixing their errors, not tax or legal advice.
11. Usage Rights
For the term of the agreement you receive a simple, non-transferable right to use the apps in your store as intended. All rights to the apps, their software, documentation and trademarks remain with us. You may use the documents and exports generated by the apps without restriction.
"Shopify" is a trademark of Shopify Inc.; AppHighway is an independent provider. "DATEV" is a trademark of DATEV eG; DATEV Abgleich is not a product of DATEV eG and is neither certified nor supported by it.
12. Changes to these Terms
We may amend these terms if the legal situation, Shopify's requirements, or the apps' scope of functionality change. We announce changes at least 30 days before they take effect by e-mail to the store e-mail address on file with Shopify, or in the app's dashboard. If you do not object within this period, or continue to use the app afterwards, the amended terms apply. If you object, the contract ends when the change takes effect; we point out this consequence in our notice. The version in force at any time, with its version number and date, can be found on this page.
13. Final Provisions
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods and conflict-of-law rules. The exclusive place of jurisdiction for all disputes arising from this contract is the court with subject-matter jurisdiction for Ledenitzen in Klagenfurt, provided you are a business; we may also sue you at your general place of jurisdiction.
Should individual provisions be invalid, the remaining provisions remain in force; the invalid provision is replaced by the applicable statutory rule. These terms are published in German and English; the German version prevails.
