Terms of Service

These terms of service ('Terms') govern your use of AppHighway, an API marketplace platform. By accessing or using our services, you agree to be bound by these Terms.

1. Description of Services

AppHighway provides the following API services:

50+ specialized APIs across data transformation, AI-powered services, utilities, and content processing
Unified authentication system with multi-token support for all APIs
Points-based billing system where each API call consumes points based on computational cost
Comprehensive API documentation with OpenAPI specifications
Developer dashboard for managing API tokens, tracking usage, and purchasing points

2. Account Registration and Security

To use our services, you must create an account and maintain its security:

Provide accurate and complete information during registration
Maintain the confidentiality of your account credentials and API tokens
Notify us immediately of any unauthorized use of your account or token compromise
You are responsible for all API calls made using your tokens
One account per person or organization; sharing accounts is prohibited

3. Prohibited Use

You agree not to use our services for any of the following purposes:

Any unlawful purpose or to solicit others to perform illegal acts
To violate any international, federal, provincial, or state regulations, rules, laws
To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
To submit false, inaccurate, or misleading information to our APIs
To upload viruses or any other malicious code that compromises system security
To attempt to reverse engineer, decompile, or hack our APIs or services
To use our services to compete with or create similar API marketplace services

4. Points-Based Billing and API Tokens

Points-Based Billing System

All API calls are billed in points. Points are deducted BEFORE processing each request. Each API has its own point cost (1-7 points per call) based on computational requirements:

Point Packages: Starter (100 points, $10), Professional (500 points, $40), Enterprise (1000 points, $70)
API Point Costs: Range from 1-7 points per call depending on complexity (e.g., CSV-to-JSON: 2 points, Structify: 3 points, AI-powered APIs: 3-7 points)
Pre-Deduction: Points are deducted atomically BEFORE processing to ensure fair billing
Insufficient Balance: API calls are rejected immediately if your points balance is insufficient

Billing and Payments

Points are purchased in packages through our payment provider Polar.sh
All payments are processed securely through Polar.sh with standard payment methods
Points do not expire and remain in your account until used
No refunds for points once purchased, except as required by law

API Token Management

Users can generate multiple API tokens with custom names and scopes for different applications:

Multi-Token Support: Create unlimited API tokens with custom names for different projects
Token Scopes: Restrict tokens to specific APIs if needed
Rate Limiting: Each token has a rate limit (default: 60 requests per minute)
Token Security: Tokens are bearer tokens and must be kept secure. We are not responsible for compromised tokens

5. Intellectual Property Rights

Our Intellectual Property

All content, features, and functionality of AppHighway and its APIs are owned by us and are protected by copyright, trademark, and other intellectual property laws.

Your API Request Data

You retain ownership of data you send to our APIs. By using our services, you grant us a limited license to process your data to provide API responses. We respect your privacy and handle data according to our Privacy Policy.

API Response Usage Rights

You have full rights to use API responses in your applications and products. However, you may not redistribute raw API responses as a competing service without adding significant value.

6. Privacy and Data Security

Your privacy is important to us. Our collection, use, and protection of your personal data and API request data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

7. Service Limitations and Disclaimers

Service Availability

While we strive for 99.9% uptime, we cannot guarantee uninterrupted service availability. Maintenance windows and technical issues may temporarily affect API access.

API Response Accuracy

IMPORTANT: Our APIs provide responses based on algorithms, data processing, and in some cases AI models. APIs can produce inaccurate, incomplete, or unexpected results. You are solely responsible for validating API responses before using them in production. We are not liable for any damages arising from the use of incorrect API responses.

Rate Limits and Fair Use

API tokens are subject to rate limits (default: 60 requests per minute). Excessive use that impacts platform stability may result in temporary throttling or account suspension. We reserve the right to adjust rate limits to maintain service quality.

Disclaimer of Warranties

Services are provided 'as is' without any warranties of any kind. We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.

8. Termination and Points

Either party may terminate this agreement under the following conditions:

You may terminate by canceling your account and deleting all API tokens
We may terminate for breach of these Terms after reasonable notice
We may immediately suspend service if we suspect fraudulent activity or API abuse
Upon termination, your right to use the APIs ceases immediately
Unused points are forfeited upon account termination with no refund, except as required by law

9. Governing Law

These Terms are governed by Austrian law. Disputes will be resolved in the courts of Austria or through binding arbitration at our discretion.
